Conveyancing Quality Scheme Update – Written SDLT and LTT Calculations

New Core Practice Management Standards (CPMS) for Conveyancing Quality Scheme (CQS)accredited firms came into effect on 1 May 2022.   

As part of our ongoing commitment to ensuring that Intelliworks conveyancing workflows are CQS compliant, we have reviewed and updated the workflows with several enhancements that address the key areas of change. 

One example of this is in relation to the new requirement to provide clients with written SDLT and LTT calculations. 

Requirement 5.15, provides that firms must have a “a procedure for ensuring that the practice provides a clear written SDLT (Stamp Duty Land Tax) calculation to the client at the outset”: 

In response to this requirement, we have therefore enhanced the Purchase and New Build Purchase workflows to include a new Letter to Client – SDLT/LTT Calculation, which confirms the tax rate payable and sets out a breakdown of the land tax calculation for the client.  This will allow users to quickly and easily provide clear, detailed calculations to the client in accordance with the Standards.     

To help users comply with this requirement, Intelliworks will prompt them to generate the new letter early in the transaction, following receipt of the client’s completed Land Tax Memo and Authority to Submit. To provide flexibility this document can also be generated directly from the Unscheduled Task List: 

 

In addition, the Land Tax Audit Sheet has been enhanced to record the date on which the tax calculation is sent. The Audit Sheet is a valuable tool for users to track the tax advice provided to the client and the steps taken to verify the tax payable.
